We are Those Beyond Studios Limited, a company incorporated and registered in England with registered address at 12 Queen Street, Bath, Somerset, England, BA1 1HE (“Those Beyond”, “we” or “us”), and we are a videogame publisher.

Where we decide the means or purpose of processing your personal data, we are the “data controller."

This policy explains how we process personal data, as a data controller, relating to:

  • those who visit or access any Website (“Website Users”), such “Website” being any web page which we operate from time to time, including any website or microsite;

  • users of our games (“Game Users”) when they access any of our games (“Games”), including any game made available as a mobile application (“App”), via a web browser and any other game alongside which we make this Privacy Policy available; 

  • users of the Discord channel that we operate; 

  • the unique in-Game characters created by Game Users by use of the Games (“Characters”);

all such individuals together being the “Users” (and “you” and “your” shall refer to any User), and all such products, services and features together being our “Products”. 

Note that we may offer our Products or our support for the same through third party application and/or games stores including, without limitation, the Apple App Store, Google Play, Discord (each a “Third Party Location”). That may mean that you need a Third Party Location account to use our Products, or obtain support, and your use of each Third Party Location is subject to the terms of use and privacy policy applicable to that Third Party Location.

We update this policy from time to time, so Users should check back in on a regular basis. Where appropriate, we will actively notify you.

Please note that other websites or services mentioned or linked to on our Products are not operated by us, and you should refer to the privacy policies on those websites to understand how their personal data is being used.

This Privacy Policy should be read in conjunction with any other terms of use or end user licence agreement (“Other Terms”) as may be applicable to our Products. Where Other Terms are applicable, they will be made available via such Products.

What is this policy about?

Users have the following rights, although these rights may be limited in some circumstances:

  • Ask us to send a copy of your personal data to you or someone else

  • Ask us to restrict, stop processing, or delete your personal data

  • Object to our processing of your personal data

  • Object to use of your personal data for direct marketing purposes

Gameplay data

We process the following personal data about our Games:

  • Your Third Party Location username and other profile details (if relevant to the way you play our Games)

  • Your device ID

  • Your device operating system & version

  • Your device make and model

  • Game play attempts, progression and results

  • Session game time start, end and duration

  • The country of your device

  • The time, date and install source of your first download

  • Identification of crashes and defects

We use this personal data to allow Game Users to use our Games (including certain functionalities on our Games), identify and correct any problems in our Games (such as bugs or problems preventing in-Game progression); understand how Game Users use our Games; and perform essential business operations. 

Our legal justification for using your personal data:

We process this personal data where it is necessary for the performance of a contract which Game Users are a party to.

We also process this personal data to pursue our legitimate interests, including to:

  • Improve the delivery of our Games

  • Operate our business and promote its success

Enquiry data

We process the following personal data in relation to Users when they get in touch with us. For example, when they submit any enquiries, complaints or questions about our Products:

  • Name;

  • Contact information (such as email address);

  • Any other information that Users submit as part of their enquiries, complaints or questions.

We use this personal data to communicate with you and provide our support services.

We process this information because it is necessary:

We may process this data in accordance with the terms of our contract with you (where we need this information to provide our Services to you) or to take steps at your request prior to entering into a contract.

We also use this to pursue our legitimate interests, including:

  • Our interest in responding to enquiries to ensure smooth operation of our business and services

Website and App Analytics

We process the following personal data in relation to Users (collected from your device and interaction with our Websites and Apps):

  • How often you use our Websites and Apps

  • Which webpages/application screens you go to, how long you spend on certain webpages/application screens and which features you use

  • Which webpages, emails, search engines or marketing campaigns referred you to our Websites or Apps

  • Your IP address, and device identifiers communicated by your device or browser

  • Device and browser operating system, version, make and model

We process this information so that we can understand usage of our Websites and Apps and improve them.

We may further process this information for online marketing and advertising, including:

  • Remarketing, which allows us to show ads to people on third party services (for example, Facebook), who have previously visited our Websites and Apps; and

  • Ad performance monitoring, meaning that your information may be used to understand how ads have performed or how many people have viewed certain ads.

We process this personal data based on your consent, which is collected via the cookie banner on our Websites, or in the case of our Apps via our Apps. 

We collect this data from Users via cookies and other tracking technology, please see more detail on this and the third parties who may have access to this data in Section 3 below. 

We collect the following information directly from Users when they submit job applications via our Website: 

  • Name

  • Contact Information

  • Any other information that Users submit as part of their job application, including any resumé/CV, cover letter and confirmation of whether they are within a commutable distance to the relevant locations (if and where relevant).

We process certain information about Users to assess whether they are suitable for a role at Those Beyond, including to consider their skills and qualifications, when they submit a job application through our Website. Where relevant, we’ll also communicate with Users about the role and the recruitment process and keep appropriate records of the process.

We process this personal data in pursuit of our legitimate interests: (a) in deciding whether the User is a suitable candidate and whether to appoint the User; (b) to enter, perform, or take steps preparatory to entering, contracts with the User; and (c) to comply with our legal obligations.

We may share some of this information with LinkedIn and Typeform, whose services support our hiring processes.

Where a User is: 

  • successful with their application, their data will be retained in accordance with our internal employee privacy notice; or 

  • not successful with their application, their data will be retained for 1 year following the date on which a decision was made on their application.

Cookies, analytics, and similar technologies

Data retention

We hold personal data for as long as necessary bearing in mind the purpose for which it was collected. At the end of the retention period, we assess whether it is necessary to continue to retain personal data to achieve the purposes for which it was collected. To determine appropriate retention periods, we consider the amount, nature, and sensitivity of the data, the potential risk of unauthorised access, and legal requirements.

Storage and transfers

We are based in the UK, regularly collaborate with an international network of partners and may from time to time use subcontractors and service providers based in other countries. Where we transfer your information outside of the UK and/or EEA, we will have agreements in place with the recipient which include standard data protection clauses adopted by a data protection regulator and/or approved by the European Commission to ensure that appropriate safeguards are in place to protect your personal data. Disclosure

We may disclose your personal data:

  • Where required by law, government, competent authorities or the courts or to establish, exercise or defend our legal rights, and for the purposes of preventing crime and fraud (for example, we may share personal data with our professional advisors, investigators, or credit reference agencies).

  • With other members of our corporate group and our international network of partners.

  • If involved in an investment, merger, acquisition, or sale of our organisation or assets, personal data we hold may be shared on the basis of the legitimate interests of us, our investors, our shareholders, customers and other parties to a transaction, unless those interests are outweighed by prejudicial impacts upon you.

Automated decision-making

We may use automated decision-making methods which do not involve human involvement to process your information and shall do so only in the ways that are described in this Privacy Policy.

Marketing information

In the event we wish to process your personal data for marketing purposes (including our newsletter which we could send via email or our Discord channel) and where not otherwise detailed in this Privacy Policy, we will obtain your prior consent to process your personal data before doing that where we are required to do so by law. In each relevant instance, if you prefer that we do not process your personal data in that way, you can let us know by simply using the relevant consent options, buttons or similar choices we provide to you at the relevant time. You can also withdraw your consent (or, if applicable, ‘opt-out’) at any time by letting us know via the email in the introduction.

Children

We take the protection of the personal data of children very seriously. In the event that we learn that we have collected personal data from a child other than as intended in accordance with this Privacy Policy, we will delete that information as quickly as possible.
